Wavetronix to Appeal Unfavorable Court Ruling

LINDON, Utah—February 15, 2007—Wavetronix LLC, the world leader in patented Digital Wave Radar™ traffic sensors, announced yesterday it has received an unfavorable ruling in its patent infringement litigation against Electronic Integrated Systems, Inc. (EIS). On February 14, 2007, Judge Bruce S. Jenkins, of the United States District Court for the District of Utah, ruled that EIS' RTMS™ X3 product does not infringe the claims of a Wavetronix patent. Wavetronix officials say the company will appeal.

“We strongly believe that the judge's ruling is incorrect,” said Wavetronix attorney Brent P. Lorimer of the Salt Lake City firm Workman/Nydegger. “We expect to file a notice of appeal within the next few weeks and we are confident that our patent infringement claims will be vindicated by the Court of Appeals.”

Wavetronix sued EIS in January of 2005, asserting that EIS infringes Wavetronix' U.S. Patent No. 6,556, 916, or the '916 patent, by selling and offering to sell the RTMS X3 device. The '916 patent was awarded to Wavetronix in 2003 for the company's unique process for automatically configuring multiple lanes of traffic, a feature of the company's SmartSensor™ line of non-intrusive radar detection devices.

As part of his ruling, the judge dismissed EIS' claim that the Wavetronix patent is invalid, and confirmed a previous ruling that rejected EIS' claim that the patent was obtained by fraud.
