WavetronixLINDON, Utah—June 28, 2005—Wavetronix LLC, the world leader in patented Digital Wave Radar™ traffic sensors, has filed a complaint against Electronic Integrated Systems, Inc. (EIS) to protect its patented technologies and processes. The complaint alleges that EIS is infringing Wavetronix' U.S. Patent No. 6,556,916 by selling and offering to sell the EIS RTMS™ X3 device.
The complaint, filed yesterday in the United States District Court for the District of Utah, seeks preliminary and permanent injunctive relief, as well as damages in an amount to be established at trial. The Wavetronix patent entitles Wavetronix to prevent the manufacture, use, sale and offer for sale in the United States of products or methods that fall within the scope of the patent's claims.
The '916 patent was awarded to Wavetronix in 2003 for the company's unique automatic configuration process, which defines traffic lanes by detecting vehicles within its field of view; defining and recording vehicle positions; and then defining lane positions. The patented technology is sold by Wavetronix in the form of its SmartSensor™ products and is capable of auto-configuring up to eight lanes of traffic simultaneously without requiring manual set up or definition of lane boundaries.
David Arnold, CEO and co-founder of Wavetronix, says patents are a valuable and necessary part of technological innovation because they encourage businesses to take risks. “We have a responsibility to use the patents we've received to protect our technology,” he says. However, Arnold stresses this is not a move to dominate the market. “We welcome fair competition, and we believe there is plenty of room for fair competition outside the scope of this patent.”
